Having heard the appeal of OWNER/TRAINER/DRIVER, AUTHORIZED AGENT, DAVID ADAM KELLY, PERM. ADD.: WHEATLAND COUNTY, ALBERTA, CANADA, D.O.B. OCTOBER 11, 1989, regarding HORSE RACING ALBERTA Ruling #57 dated August 24, 2024, whereas the penalty granted is a suspension of thirty (30) calendar days (driving only), August 26 to September 24, 2024 (inclusive).

The Appeal Tribunal has amended the thirty (30) day driving suspension imposed on Mr. Kelly and has hereby reduced the penalty to a ten (10) calendar day driving suspension from June 26 to July 5, 2025 (inclusive). In the event that any race days within that time frame are cancelled and HORSE RACING ALBERTA makes up races, the suspension shall apply to the make up days.

The appeal fee to be forfeited.

In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, AUTHORIZED AGENT, LOGAN KEATON GILLIS, PERM. ADD.: CALGARY, ALBERTA, CANADA, D.O.B. SEPTEMBER 5, 1990, did violate HORSE RACING ALBERTA Rule 458(2)(a)(ii)(c)(ii); At any time while on the grounds of an Association, it is a violation of the Rules for a driver, or the person in control of the horse, to engage in any of the following actions with respect to their driving conduct: excessive action, which is characterized by unreasonable quantity or degree, including using the whip continuously and/or without allowing the horse time to respond. At any time while on the grounds of an Association, the whip shall only be used for safety purposes and for very light encouragement. The only movement allowed to encourage a horse is a movement of the wrist. It is a violation of the Rules for a driver, or the person in control of the horse, to use the whip to hit or make contact with the horse as follows: to use more than acceptable wrist action, while driving “ITS TIME ICEMAN” in Race 1, Wednesday, June 25, 2025.

PENALTY: LOGAN GILLIS is hereby FINED THE SUM OF ONE HUNDRED DOLLARS ($100.00).

In accordance with HORSE RACING ALBERTA Rule 297(1) fine to be paid within ten (10) days.

MEETING: Century Downs, Balzac, Alberta, Canada - June 26, 2025

In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, JACQUES WILFRED LAMBERT, PERM. ADD.: RED DEER COUNTY, ALBERTA, CANADA, D.O.B. OCTOBER 14, 1982, did violate HORSE RACING ALBERTA Rule 286; A person violates these rules who, (a) in the opinion of the judges/stewards board, conducts themselves in a manner prejudicial to the best interest of horse racing (b) does not comply with these or any other rules; and Rule 287(1) A person violates these rules who (xxviii) uses profane or indecent language at a race track ; (xxx) disturbs the peace at a race track; for different incidents involving HORSE RACING ALBERTA Security and other participants in the barn area concerning the retention barn during the race card on Saturday, June 21, 2025.

PENALTY: JACQUES LAMBERT is hereby FINED THE SUM OF FIVE HUNDRED DOLLARS ($500.00). Mr. Lambert must also complete the “Respect In The Workplace” online program to be completed by July 10, 2025, and agree to conditions placed on his licence effective until December 31, 2025.

In accordance with HORSE RACING ALBERTA Rule 297(1) fine to be paid within ten (10) days.

In the opinion of the Board of Judges, TRAINER/DRIVER, TERRY DEAN KAUFMAN, PERM. ADD.: ALDERGROVE, BRITISH COLUMBIA, CANADA, D.O.B. JUNE 18, 1973, did violate HORSE RACING ALBERTA Rule 458(2)(a)(ii)(c)(ii); At any time while on the grounds of an Association, it is a violation of the Rules for a driver, or the person in control of the horse, to engage in any of the following actions with respect to their driving conduct: excessive action, which is characterized by unreasonable quantity or degree, including using the whip continuously and/or without allowing the horse time to respond. MAY 3, 1962, is hereby FINED THE SUM OF ONE HUNDRED DOLLARS ($100.00) for failing to notify HORSE RACING ALBERTA Security that the horse “FIRST GOLD DASH” would be shipped in to Century Mile Racetrack and Casino on Wednesday, June 18, 2025.

In accordance with HORSE RACING ALBERTA Policy No. RLP012 dated August 14, 2024.

JOCKEY, LARRIS HUGH ALLEN, PERM. ADD.: KINGSTON, JAMAICA, D.O.B. OCTOBER 27, 1976, is hereby FINED THE SUM OF THREE HUNDRED DOLLARS ($300.00) for allowing his mount #2 “STREET ART” to come in before being properly clear during the stretch run, interfering with #1 “FLASH OF GLORY” on his inside thereby causing #2 “STREET ART” to be DISQUALIFIED from 1st and placed 3rd in Race 1, Sunday, June 15, 2025.

OWNER, MAX GERALD GIBB, PERM. ADD.: MILLARVILLE, ALBERTA, CANADA, D.O.B. JULY 13, 1941.

Having reviewed the complaint regarding the conduct of Owner, Max Gibb and the circumstances surrounding incidents on Monday, April 28, 2025, makes the following findings and sanctions.

Following three (3) separate notices issued to Mr. Gibb for a scheduled hearing into his behaviour, the third notice was hand delivered by a HORSE RACING ALBERTA Security Investigator, Mr. Gibb refused to accept the notice and responded with profane, disrespectful and unprofessional language toward the HORSE RACING ALBERTA Official attempting the delivery. Mr. Gibb did attend the Judges/Stewards Board Hearing on Tuesday, June 17, 2025 on a Teams Hearing.

Evidence presented during the hearing confirms that on April 28, 2025, at approximately 4:04 p.m., Mr. Gibb placed a telephone call to an appointed Steward. The Steward was at home, accompanied by his wife and the call was on speaker phone. During this call, Mr. Gibb used foul, abusive and disrespectful language toward a Steward.

This conduct constitutes a serious breach of the standards expected of licensed participants and is considered prejudicial to the best interests of horse racing.

OWNER, MAX GIBB is hereby FINED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) for his unprofessional and abusive conduct toward an appointed Racing Official on April 28, 2025.

Mr. Gibb is further directed to submit a formal written letter of apology to Steward, Scott Dahl. This letter must also be received by the Board of Judges/Stewards within ten (10) days. Failure to comply with the terms of this ruling may result in further disciplinary action as authorized under the Rules of HORSE RACING ALBERTA.

In accordance with HORSE RACING ALBERTA Rule 9.1(g), 286(a), 287(1)(iii), 295(2)(b) and 296(1)(a)(2)(a).
