In the opinion of the Board of Judges, DRIVER, DAVID PAUL HUDON, PERM. ADD.: SURREY, BRITISH COLUMBIA, CANADA, D.O.B.: FEBRUARY 16, 1964, did violate HORSE RACING ALBERTA Rule 458(2)(a)(ii)(c)(i)(d)(i); At any time while on the grounds of an Association, it is a violation of the Rules for a driver, or the person in control of the horse, to engage in any of the following actions with respect to their driving conduct: excessive action, which is characterized by unreasonable quantity or degree, including using the whip continuously and/or without allowing the horse time to respond; At any time while on the grounds of an Association, the whip shall only be used for safety purposes and for very light encouragement. A racing official or racing participant violates these rules if they report to work with blood/alcohol concentration reading of more than 50 milligrams of alcohol in one hundred milliliters of blood.

OCTOBER 24, 1990, did violate HORSE RACING ALBERTA Rule 123(1)(2); Any person who is responsible for a racehorse stabled on the grounds of a racetrack for the purpose of racing must ensure that a negative test for equine infectious anemia (Coggins test) dated in the preceding 12 months (365 days), has been issued with respect to that horse. No person may bring a horse onto the grounds of a racetrack or permit the entry of a horse onto the grounds of a racetrack, unless a certificate of a negative test for equine infectious anemia has been issued with respect to that horse in accordance with subsection (1); for having a horse shipped in without a current negative Coggins test.
