WHEREAS on August 23, 2024, the Board of Judges issued Harness Ruling #55 dated August 23, 2024, and Harness Ruling #56 dated August 23, 2024, against OWNER/TRAINER/DRIVER, AUTHORIZED AGENT, JOHN BRANDON SCOTT CAMPBELL, PERM. ADD.: CALGARY, ALBERTA, CANADA, D.O.B. JULY 5, 1983, and WHEREAS on or about August 26, 2024, Mr. Campbell filed a Notice of Appeal with respect to Ruling #55 and Ruling #56 and WHEREAS on August 29, 2024, the Alberta Horse Racing Appeal Tribunal issued a stay of Ruling #55 and Ruling #56 until a hearing of said appeals could occur; and WHEREAS the appeals of these Rulings were scheduled for March 13 and March 14, 2025, and WHEREAS Mr. Campbell and HORSE RACING ALBERTA have reached a resolution of the issue under appeal.

It is ordered by the Director, Regulatory and Supervisor of Racing that, for a violation of HORSE RACING ALBERTA Rule 458(1)(p)(2)(iii)(b)(v) to be AMENDED to Rule 458(2)(b)(v); to wit; The whip shall not be used on a horse in a race where the horse has passed the winning post at the finish of a race; while driving “DISCONTINUED” in Race 3, Saturday, August 17, 2024. JOHN BRANDON SCOTT CAMPBELL, is hereby SUSPENDED THIRTY (30) CALENDAR DAYS (DRIVING ONLY) WITH CONDITIONS TO BE PLACED ON HIS LICENCE.

The 30 day penalty is as follows, JOHN BRANDON SCOTT CAMPBELL, as agreed to by the parties, will be SUSPENDED AS FOLLOWS: September 7 to September 13, 2025, suspended (driving only); September 14, 2025, not suspended; September 15 to September 30, 2025, suspended (driving only); October 1 to October 7, 2025 suspended days are stayed.

Appeal fee to be forfeited.

ADD.: CALGARY, ALBERTA, CANADA, D.O.B. JULY 11, 1994, is hereby RESTORED TO GOOD STANDING AND IS ELIGIBLE TO APPLY FOR A 2025 HORSE RACING ALBERTA LICENCE WITH CONDITIONS.

The public comment period for the proposed countermeasures, with feedback from business, stakeholders, and Canadians regarding their impacts has been extended to April 2nd.

Once again, we strongly encourage all industry stakeholders to submit their input through this comment submission form and request an exemption to the Canadian tariffs for purebred breeding and racing horses at https://forms-formulaires.alpha.canada.ca/en/id/cm7upmkx9008rx268zhy9l6pj.

Please make sure you make a note of the following HS Tariff Items in your exemption request:

HS Tariff Item 0101.29.00.20 – Other For Racing

A few key points we would ask you to include in your submissions:

  1. The movement of horses across borders is essential for Thoroughbred, Standardbred and Quarter Horse breeding, racing, and sales, and any additional trade barriers would have severe economic consequences. Such tariffs could discourage international investment, limit market opportunities, and place an undue burden on Canadian Thoroughbred, Standardbred and Quarter horse breeders, trainers, and owners who rely on the ability to import and export horses efficiently.
  2. In order to avoid further negative impacts to important Canadian industries that support rural Canadians and that are already suffering negative impacts from the new U.S. tariffs, we strongly believe that purebred Thoroughbred, Standardbred and Quarter Horses used for breeding and racing purposes should be exempted from the implementation of the proposed countermeasures in response to the new U.S. tariffs on Canadian goods.

In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, FARRIER/PLATER, CHRISTOPHER ADAM BROWN, PERM. ADD.: WAWANESA, MANITOBA, CANADA, D.O.B. NOVEMBER 20, 1986, did violate HORSE RACING ALBERTA Rule 458(1)(p)(2)(a}(i)(iii}(b){v)(c); A driver shall not commit any of the following acts which are considered violations of driving rules: uses a whip in a brutal, excessive or indiscriminate manner. At any time while on the grounds of an Association, it is a violation of the Rules for a driver, or the person in control of the horse, to engage in any of the following actions with respect to their driving conduct: indiscriminate action, which is characterized by unrestrained or careless activity; aggressive action, which is characterized by inhumane, severe or brutal activity. The whip shall not be used on a horse in a race where the horse has passed the winning post at the finish of a race. At any time while on the grounds of an Association, the whip shall only be used for safety purposes and for very light encouragement. The only movement allowed to encourage a horse is a movement of the wrist; while driving "PULL THE TRIGGER" in Race 7, Wednesday, January 29, 2025.

PENALTY: CHRISTOPHER BROWN is hereby SUSPENDED THIRTY( 30) CALENDAR DAYS(DRIVING ONLY) FEBRUARY 13 AND FEBRUARY 14 AND MARCH 29 THROUGH TO APRIL 25, 2025 (INCLUSIVE).

In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, FARRIER/PLATER, CHRISTOPHER ADAM BROWN, PERM. ADD.: WAWANESA, MANITOBA, CANADA, D.O.B. NOVEMBER 20, 1986, did violate HORSE RACING ALBERTA Rule 458(2)(a)(ii)(c)(ii); A driver shall not commit any of the following acts which are considered violations of driving rules: At any time while on the grounds of an Association, it is a violation of the Rules for a driver, or the person in control of the horse, to engage in any of the following actions with respect to their driving conduct; excessive action, which is characterized by unreasonable quantity or degree, including using the whip continuously and/or without allowing the horse time to respond. At any time while on the grounds of an Association, the whip shall only be used for safety purposes and for very light encouragement. The only movement allowed to encourage a horse is a movement of the wrist. It is a violation of the Rules for a driver, or the person in control of the horse, to use the whip to hit or make contact with the horse as follows: to use more than acceptable wrist action; while driving "PULL THE TRIGGER" in Race 8, Friday, February 7, 2025.

PENALTY: CHRISTOPHER BROWN is hereby FINED THE SUM OF ONE HUNDRED DOLLARS ($100.00).

In the opinion of the Board of Judges, TRAINER, AUTHORIZED AGENT, MATHEW PATRICK HOWLETT, PERM. ADD.: WINNIPEG, MANITOBA, CANADA, D.O.B. MAY 10, 2000, did violate HORSE RACING ALBERTA Rule 287{1)(xiii)(a)(b); A person also violates these rules who, unless the person is the official veterinarian or a licensed veterinarian or an animal health technologist, has in their possession, or in their effects, or under their control, drugs, hypodermic syringes, needles, or any like paraphernalia at or near a race track or stable area, or in premises or accommodation occupied on or near the grounds of a race track; as the result of a barn search conducted on January 30, 2025.

PENALTY: MATHEW HOWLETT is hereby FINED THE SUM OF FIVE HUNDRED DOLLARS ($500.00).

In accordance with HORSE RACING ALBERTA Rule 297(1) fine to be paid within ten {10) days.

January 8, 2025

Having received confirmation on Thursday, October 31, 2024, of a POSITIVE TEST for MARIJUANA from Dynacare Laboratories dated Sunday, October 27, 2024, JOCKEY, ANDRE NICHOLAS MARTIN, PERM. ADD.: EDMONTON, ALBERTA, CANADA, D.O.B. OCTOBER 12, 1988, is hereby SUSPENDED FROM RACE RIDING FOR TEN (10) CALENDAR DAYS AND FINED THE SUM OF THREE HUNDRED DOLLARS ($300.00). Having SERVED one day (1) of his SUSPENSION, October 27, 2024, Mr. Martin is hereby SUSPENDED FOR NINE (9) CALENDAR DAYS STARTING APRIL 29, 2025 THROUGH TO TUESDAY, MAY 7, 2025 (INCLUSIVE). (Second offence.)

In accordance with HORSE RACING ALBERTA Rule 296(1)(a)(2)(a)(b) and 300(1)(b)(c)(2)(b).

Fine must be paid in full before Mr. Martin can apply for a HORSE RACING ALBERTA licence for the 2025 racing season.

In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, AUTHORIZED AGENT, LOGAN KEATON GILLIS, PERM. ADD.: CALGARY, ALBERTA, CANADA, D.O.B. SEPTEMBER 4, 1990, did violate HORSE RACING ALBERTA Rule 456(ix); A monetary penalty and/or a suspension may be applied by the starter or by the Judges for any of the following violations contained in subsections (i)-(vii). In addition, the Judges may place the offending horse for a violation of subsections (iii), (iv) or (vi) of this rule: changes course or position, or swerves in or out, or bears in or out during any part of the race in a manner that compels another horse to shorten its stride or cause another driver to change course, take the horse back, or pull the horse out of its stride; while driving "VINNY N THE ICEMAN" in Race 7, Saturday, January 25, 2025.

In accordance with HORSE RACING ALBERTA Rule 276(2)(a) "VINNY N THE ICEMAN" is DISQUALIFIED from 2nd and placed 6th.

PENALTY: LOGAN GILLIS is hereby SUSPENDED FOR TWO (2) RACE DAYS (DRIVING ONLY), FEBRUARY 5 AND FEBRUARY 8, 2025.

In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, AUTHORIZED AGENT, LOGAN KEATON GILLIS, PERM. ADD.: CALGARY, ALBERTA, CANADA, D.O.B. SEPTEMBER 4, 1990, did violate HORSE RACING ALBERTA Rule 223(1); Drivers must report to the paddock judge at least one hour before post time of any race in which they are programmed to driver, unless excused by the Judges; for being late for the breathalyzer on Saturday, January 25, 2025.

PENALTY: LOGAN GILLIS is hereby FINED THE SUM OF FIFTY DOLLARS ($50.00).

In the opinion of the Board of Judges, OWNER/TRAINER/DRIVER, KELLY ORVIN HOERDT, PERM. ADD. BEAUMONT, ALBERTA, CANADA, D.O.B.: MARCH 19, 1966, did violate HORSE RACING ALBERTA Rule 460; Drivers shall keep both feet in the stirrups during the post parade, while in front of the grandstand, and from the time the horses are brought to the starting gate until the race has been completed. Drivers shall be permitted to remove a foot from the stirrups during the course of the race solely for the purpose of pulling ear plugs and once these have been pulled, the foot must be placed back into the stirrup. If a driver's foot is in the stirrup, he or she shall not allow his/her foot to hit a horse in any manner; while driving "LITE OF THE DRAGON" in Race 4, Wednesday, January 8, 2025.

PENALTY: KELLY HOERDT is hereby FINED THE SUM OF ONE HUNDRED DOLLARS ($100.00).

In accordance with HORSE RACING ALBERTA Rule 297(1) fine to be paid within ten (10) days.
